1. Status of Terms
1.1 These terms constitute a legal document ("the Agreement") which sets out the rights and obligations of you as a purchaser ("you"), and those of BraZen Gaming Limited (Company Registration Number 11695482) (T/A BoysStuff.co.uk, ("BoysStuff", "we" or "us"), in relation to the services and products offered by us through this site or any of the other sites owned by us. By registering for BoysStuff services, you agree to the terms of this Agreement, and you re-affirm that agreement every time you use any of our services. 
1.2 You agree to:)
1.2.1 provide true, accurate, current and complete information about yourself as prompted by our registration form (such information being the "Registration Data"); and
1.2.2 maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or BoysStuff has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, BoysStuff has the right to suspend or terminate your account, cease supply and refuse you any and all current or future use of the BoysStuff site (or any portion of it).
1.3 BoysStuff is concerned about the safety and privacy of all its users, particularly children. For this reason, parents who wish to allow their children access to the site should assist them in setting up any relevant accounts and supervise their access to the site. Once you have allowed your child access to the site he/she will be able to access all of the site. Please remember that the site is designed to appeal to a broad adult audience. Accordingly, as legal guardian, it is your responsibility to determine whether the site is appropriate for your child.
1.4  The BoysStuff.co.uk website is owned and operated by BraZen Gaming Limited (Company Registration Number 11695482) .  However, please note that by purchasing a product available on the BoysStuff.co.uk website you may transact with either BraZen Gaming Limited (Company Registration Number 11695482)  ("BoysStuff .co.uk") or its partners and agents.  This is because we source, store and supply our products from different places so that we can price competitively.  The BoysStuff entity you will transact with will depend on where we are going to supply the particular product you are purchasing.  This information is available to customers upon request and/or in the narrative of each product you purchase.

2. Place of performance and applicable law.
BraZen Gaming Limited (Company Registration Number 11695482) is a company registered in England. Unless otherwise specified, the materials on this site are directed solely at those who access this site from the United Kingdom mainland. BoysStuff makes no representation that any product referred to in the materials on this site is appropriate for use, or available, in other locations. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable. English law shall govern this Agreement.  All legal disputes must be conducted in an English Court located in the West Midlands area.
 
You and we each submit to the exclusive jurisdiction of the English courts in relation to disputes arising out of this Agreement. If any provision of this Agreement shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

3. Placing an order
3.1 A notice will be displayed on your web browser before you submit an order with BoysStuff ("the Pre-contract Notice"). The Pre-contract Notice contains important information such as a description, price (including export taxes) and delivery charges of the good or services ordered. BoysStuff suggests that you print off a hard copy of the notice or save a copy to your hard drive for your own records.
3.2 BoysStuff will not be obliged to supply the goods or services submitted in your order until you have received an e-mail from BoysStuff accepting your order ("Order Confirmation"). However, in the event the goods or services are listed on BoysStuff`s site at an incorrect price due to typographical error or error in pricing information received from its suppliers but BoysStuff have accepted your order before the discrepancy is noticed, BoysStuff shall e-mail you to ask whether you are willing to pay the correct price for the goods or services ordered. If you are unwilling to pay the correct price BoysStuff reserves the right to cancel the contract immediately without any liability to you.
3.3 If BoysStuff exercises its right under clause 3.2 to cancel a contract it will issue a credit to your debit or credit card account or other appropriate method of repayment it chooses if it has already made a charge to your card or similar before cancelling your order.
3.4 In the event that the goods ordered by you are not available BoysStuff reserves the right to provide you with goods of a similar quality and specification. Your statutory rights to return any unwanted product are unaffected if you receive a substitute product. In the case where you decide a substitute product is unwanted we will suffer the reasonable costs associated with the transaction.

4. Right to cancel
4.1 You have the right to cancel any contract either:  
4.1.1 within fourteen days from the date of delivery if BoysStuff has supplied goods to you; or
4.1.2 within fourteen days from the date BoysStuff sent you the Order Confirmation if BoysStuff has contracted to supply services to you, provided that BoysStuff has not started to provide those services before the expiry of the cancellation period.
4.2 The cancellation notice should be sent in a durable medium, for example, by e-mail to customercare@BoysStuff.co.uk or visit the contact us page on the BoysStuff.co.uk website.  The Cancellation Request must state your name and address, a description of the goods or services concerned and the contract number of the cancelled contract. Attaching the Order Confirmation BoysStuff originally sent you will also assist BoysStuff in processing your cancellation as quickly as possible. The contract number is stated in the Order Confirmation e-mailed to you on BoysStuff`s acceptance of your order.   As appropriate you should also provide order date and delivery date.

4.3 Where BoysStuff have supplied goods to you, you must take reasonable care of the goods in your possession pending their return to BoysStuff. BoysStuff will only accept the returned goods which are unused, resaleable condition and suitably packaged for its return Any use of the delivered goods beyond that necessary to inspect the goods on delivery will invalidate your right to cancel the contract. Exceptions - We are sorry but self assembly furniture - eg gaming chairs (once partly or wholly assembled) cannot be refunded or exchanged unless faulty.
4.4 You must return the goods to BoysStuff by registered post or similar within fourteen days (excluding Saturdays, Sundays or Bank Holidays) from the date of the Cancellation Notice. You are responsible for the cost of returning the goods to BoysStuff and the risk of damage to the goods in transit. If the goods are damaged in transit BoysStuff reserves the right to refuse a refund and it will be your responsibility to seek compensation from the carrier.
4.5 Once BoysStuff has received the returned goods and satisfied itself that you have complied with clause 4.3, it will send you confirmation by e-mail that the return of the goods has been accepted by BoysStuff and will make a refund of the price of the goods and/or services originally purchased to your debit or credit card used to purchase the goods or by cheque or other appropriate method it chooses.

5. Content
5.1 BoysStuff has taken reasonable care in the preparation of the content of this site. However, to the extent permitted by applicable law, BoysStuff disclaims all warranties (express or implied) as to the accuracy of the information contained in any of the materials on this site.
5.2 BoysStuff shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained in any of the materials on this site.
5.3 Certain links in this site (typically a banner advert or icon) will lead to sites which are not under the control of BoysStuff. When you activate any of these you will leave the BoysStuff site and BoysStuff has no control over and will accept no responsibility or liability for the material on any site which is not under the control of BoysStuff.

6.  No Quibble Returns!!
Because we are just SO NICE, if you're not completely satisfied with any of the goods you have ordered from BoysStuff for any reason, or if on the off chance you have received a lemon (i.e.: damaged or defective goods) we’ll let you return them (subject to compliance with Right to Cancel terms as set out above in Section 4).   To our outsourced warehouse - Unit 2, Hornbrook Farm, Cornets End Lane, Meriden, Coventry, CV7 7LH.
If you wish to return your unwanted gift, you must notify BoysStuff within fourteen days of receipt of your product. The cost of your product will be refunded to the credit/debit card used to make the purchase or by cheque once we have received the returned product. Please note refunds take at least 5 working days to clear from the point of processing. This does not affect your statutory rights.
When returning unwanted goods they must be sent back in their original condition and packaging (if any) with all warranty cards, licences, manuals and accessories. You must use recorded delivery - neither BoysStuff nor the supplier can be held responsible for returned items that go missing in the post. It is the responsibility of the customer to ensure that the goods being returned are packaged to ensure the item is not damaged in transit.

How to do it:

Contact BoysStuff and request a RMA number (this will be used to track your return at BoysStuff). Please note that any items returned without a RMA and/or Order Confirmation Number will probably take longer to be  processed. Write the RMA number and the Order Confirmation Number on the outside of the parcel below the return address. Return the item to the address provided, and we will process the return within fourteen days of receipt. 

Once the item has been returned to us we will process the return and repair, refund, replace as we determine.

*Please note if the gift is an unwanted gift, and the item has been modified, misused, damaged and / or is not in resalable condition we will not be able to provide a refund / replacement.

*If the item is faulty we will examine the item and determine the reason for the fault and refund / replace as we determine.

*Unfortunately we are not able to accept returns for self assembly furniture eg gaming chairs (once partly or wholly assembled) unless faulty.  Goods must be returned in the condition received. The customer will be given a full refund of the price that has been paid for the goods. Any return delivery or gift-wrapping charges will not be refunded, unless the item was deemed to be faulty when received.
Unless advised in writing to the contrary it should be assumed that the warranty period for faulty goods is twelve months from date of purchase.  Full details of warranty is available upon request.
For the avoidance of doubt the warranty only covers manufacturing faults and not mis-use.
The decision as to whether a fault is a manufacturing one is at the sole discretion of BraZen Gaming Limited and no discussion of any such decision will not be entered into.
For the avoidance of doubt the warranty does not cover faults with power cables, audio cables, arms or castors
 
Definitions: 

Unwanted item: This is an item purchased and deemed unwanted by the purchaser. The item must be returned in re-sellable condition. If the item has been partially assembled, or the item has been modified, used, or otherwise played with we will not be able to provide a refund/replacement.  It is the responsibility of the customer to return unwanted items at their own expense.

Faulty Item: a faulty item is one that is faulty due to manufacturing fault only. If the item has been misused, abused, damaged through use or otherwise modified we will not be able to provide a refund.

 
7. Limitation of Liability
7.1 Nothing in this Agreement shall affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of BoysStuff.
7.2 Subject to clause 7.1, you agree that BoysStuff shall not be liable either in contract, tort, negligence, statutory duty or otherwise, for any:
7.2.1 loss of profits, revenue or goodwill or any type of consequential, indirect or special loss or damage whatever arising from or in any way connected with this Agreement;
7.2.2 direct loss or damage (including loss or damage which is reasonably foreseeable or occurs naturally in the course of things) resulting from any acts, omissions, failures or delays occurring on or in relation to those parts of the Internet not under BoysStuff`s direct control including, without limitation, damage for loss of business, loss of sales, non payment of sums due, loss of profits, business interruption, loss of reputation, loss of business information, or any other pecuniary loss (even where BoysStuff has been advised of the possibility of such loss or damage).
7.3 You also agree that (except in relation to such liability as has been expressly excluded in clause 7.1 above) the maximum aggregate of liability of BoysStuff in contract, tort, negligence, statutory duty or otherwise (even where BoysStuff has been advised of the possibility of such loss or damage), for any loss or damage whatever arising from or in any way connected with:
7.3.1 any defect in a product;
7.3.2 any failure by BoysStuff to process signals, data, information, orders or messages correctly or in a timely manner;
7.3.3 any misrouting or non-delivery of signals, data information, messages or orders from you to other persons or from other persons to you, or any scrambling or distortion of data or information contained in them; and
7.3.4 any liability not excluded by this Agreement shall, in respect of any one or more events or series or events (whether connected or unconnected) taking place within any twelve month period be limited, in the case of defects falling within clause 7.3.1, to three times the price of the relevant goods/services. This limit shall also apply in the event that any exclusion or other provision contained in this Agreement is held to be invalid for any reason and BoysStuff becomes liable for loss or damage that could otherwise have been limited.
 7.4 You agree and acknowledge that you are in a better position than BoysStuff to foresee and evaluate any potential damage or loss that you may suffer in connection with the goods and services provided by BoysStuff, and therefore that BoysStuff cannot adequately insure in respect of such liability. You warrant to BoysStuff that you will insure against, or bear yourself, any loss for which BoysStuff has excluded liability.
7.5 Please be aware that it is the responsibility of individual customers to ensure that the product they purchase from us (eg gaming chair) is compatible with any device or surface it is connected to. We do not accept any responsibility whatsover, except for negligence and/or death, for any problems arising with other devices or surface from use of our products.
7.6 Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations of liability set out in this clause 7 may not apply to you.  The decision as to whether an item is deemed to be faulty or is final.

8. Indemnity
Save to the extent that it falls within the provisions of clause 7, you shall indemnify BoysStuff and any third party (including its sub-contractors) from and against any liability, losses, rights, expenses, loss of profits, business interruption, consequential loss, pecuniary loss, claims or legal proceedings, including, but not limited to claims involving defamation and intellectual property infringement, and expenses, including legal fees, arising from your use of the BoysStuff site or purchase of goods and/or services from that site which are brought or threatened against BoysStuff or suffered or incurred by BoysStuff by another person or entity.
BoysStuff requires their customers, suppliers and partners to accept their own responsibility in any mishandling of their authentication credentials in respect of our computer systems.  It is required that customers, suppliers and partners ensure their authentication credentials are committed to human memory as BoysStuff does not accept any responsibility for authentication credentials that have been stored by customers, suppliers and partners on any other medium.

9. Delivery
Delivery times quoted are estimates only, and BoysStuff shall not be liable for any delays caused except to the extent caused wilfully or negligently by BoysStuff. However, unless we have agreed a longer period for delivery with you, we will either deliver goods and/or services within thirty days of you placing the order or we will let you know as soon as it will not be possible to meet this obligation. If we do let you know then we will either agree a new time for delivery with you or, at your request, refund any monies paid by you in respect of the delayed goods/services.  When a delivery option is selected (eg next day delivery, Saturday delivery, etc) we will use reasonable endeavours to deliver on this request but will have no liability if having made reasonable endeavours the delivery option is not honoured.
Short deliveries (ie a delivery where only part of the order is delivered) must be notified to us in writing within 7 days of delivery.

10. Promotion Codes
From time to time BoysStuff issues promotion codes to various interested parties for various reasons.
The decision as to whether to honour a promotion code is BoysStuff's right to exercise at its sole discretion.  Promotion codes are not a contractual obligation of BoysStuff to honour.
BoysStuff will not enter into any correspondence concerning any decision it makes about promotion codes.

11. Complaints handling procedure
 In the event that you have any complaints as to our service or any of the goods and services supplied to you from our site, please refer to our complaints handling procedure which is set out on this site.
 
 12. Copyrights
 All designs, text, graphics and their selection and arrangement on this site are the copyright of BoysStuff or its content providers. As a visitor to the BoysStuff site you are licensed to copy electronically or to print portions of this site for your own personal, non-commercial use. Any other use of materials on this site without BoysStuff`s prior written consent is strictly prohibited.
 
13. Software
13.1 Intellectual property rights in any software or any other copyrighted materials ("Software") and supporting documentation supplied by us to you remain our property or that of our licensors.
13.2 Without our written consent and without affecting any applicable statutory rights under the Copyright (Computer Program) Regulations 1992 (as amended, supplemented or replaced from time to time) you shall not and shall not permit any other person to:
13.2.1 disassemble, reverse engineer, decompile or in any other way interfere with the Software;
13.2.2 copy or modify the Software; or
13.2.3 create any new Software partly or wholly based on the Software.
 13.3 Subject to the terms of this Agreement, you are licensed to use the Software and associated documentation non-exclusively, but only for the purposes identified on the site in relation to the Software. 13.4 You must not transfer, assign or sub-license your right to use the Software or attempt to do so.
 
 14. Typographical and Pricing Errors
 In the event a product or service is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we shall have the right to refuse to meet or to cancel any orders placed for that product or service whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall issue a credit to your credit card account or issue a cheque in the amount of the charge.
 
15. Matters Beyond our Reasonable Control
BoysStuff shall not be held liable for any breach of this Agreement caused by circumstances out of its control including, but not limited to, Acts of God, fire, lightening, flood, or extremely severe weather, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees), acts or omissions of Internet services providers or acts of local or central Government or other competent authorities.
 
16. Language
In the event of conflict or inconsistency between the terms of the English language version of this Agreement (including foreign currency calculations) and any translation provided by us, the English language (sterling currency) version shall prevail.
 
17. Severability
In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.
 
18. This Agreement.
This Agreement, together with our Privacy and Fraud and Piracy Policies, contains the entire agreement and understanding between the parties relating to its subject matter, and (in relation to that subject matter) supersedes any and all prior agreements, arrangements, statements and understandings, except for any fraud or fraudulent representation by either party. Accordingly, we exclude all representations and warranties relating to the subject matter of this Agreement, whether they are statutory or otherwise, as far as is possible by law. In the event of conflict or inconsistency between the above documents, the following order of priority shall apply: (1) this Agreement (2) the Privacy Policy and (3) the Fraud and Piracy Policies.

22.  LIMITED WARRANTY

The warranty obligations of BraZen Gaming Limited (“BraZen”) for its products are limited to the terms set forth below:

WHAT IS COVERED

This limited warranty covers manufacturing faults only (ie defects in material and workmanship) in its products.

WHAT IS NOT COVERED

This limited warranty does not cover any damage, deterioration or malfunction resulting from any alteration, modification, improper or unreasonable use of maintenance, misuse, abuse, accident, neglect, exposure to moisture, fire, improper packing and shipping (such claims must be presented to the carrier), lightning, power surges or other acts of nature.  This limited warranty does not cover any damage, deterioration or malfunction resulting from product assembly, any unauthorised tampering with product, any repairs attempted by anyone other than authorised by BraZen to make such repairs directly to a defect in materials and/or workmanship of this product.  This limited warranty does not cover cartons, audio cables, optical cables, power cables and adaptors, power and audio sockets on control panels, rims on meta disc bases, gas lifts, castors, armrests, star bases, springs in base plate mechanisms, or any other accessories used in conjunction with BraZen products.

Without limiting any other exclusions herein, BraZen does not warrant that the product covered hereby, including, without limitation, the technology and/or integrated circuit(s) included in the product, will not become obsolete or that such items are or will remain compatible with any other product or technology with which the product may be used.

HOW LONG THIS COVERAGE LASTS

This standard limited warranty for BraZen products is two (2) years from the date of original purchase from an approved BraZen retailer.

WHO IS COVERED

Only the original purchaser of this product is covered under this limited warranty provided they appropriately registered their warranty cover with BraZen within 30 days of original purchase.  The onus is on the purchaser to prove appropriate registration.  This limited warranty is not transferable to subsequent purchasers or owners of the product.

WHAT BRAZEN WILL DO

BraZen will, at its sole option, provide one of the following three remedies to whatever extent it shall deem necessary to satisfy a proper claim under this limited warranty:

1                Elect to repair or facilitate the repair of any defective parts within a reasonable period of time, free of charge.

2                Replace this product with direct replacement or with a similar deemed by BraZen to perform substantially the same function as the original product.  If a direct or similar replacement product is supplied, the original product’s end warranty date remains unchanged and is transferred to the replacement product.

3                Issue a refund of the original purchase price less depreciation to be determined based on the age of the product at the time remedy is sought under this limited warranty.

HOW TO OBTAIN A REMEDY UNDER THIS LIMITED WARRANTY

To obtain a remedy under this limited warranty, you must contact BraZen initially by email (support@brazengamingchairs.com).

In order to pursue any remedy under this limited warranty you must possess an original, dated receipt as proof of purchase from an authorised BraZen reseller and proof that you registered your warranty within 30 days of purchase in the appropriate manner.

LIMITATION OF LIABILITY

THE MAXIMUM LIABILITY OF BRAZEN UNDER THIS LIMITED WARRANTY SHALL NOT EXCEED THE ACTUAL PURCAHSE PRICE PAID FOR THE PRODUCT.  TO THE MAXIMUM EXTENT PERMITTED BY LAW.  BRAZEN IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENT OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY.  Some countries, districts or states do not allow the exclusion or limitation of relief, special, incidental, consequential or indirect damages, or the limitation of liability to specified amounts, so the above limitations or exclusions may not apply to you.

EXCLUSIVE REMENDY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS WHETHER ORAL OR WRITTEN EXPRESS OR IMPLIES TO THE MAXIMUM EXTENT PERMISSED BY LAW.  BRAZEN SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  IF BRAZEN CANNOT LAWFULLY DISCLAIM OR EXCLUDE IMPLIED WARRANTIES UNDER APPLICABLE LAW THEN ALL IMPLIED WARRANTIED COVERING THIS PRODUCT INCLUDING WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSES SHALL APPLY TO THIS PRODUCT AS PROVIDED UNDER APPLICABLE LAW.

IF ANY PRODUCT TO WHICH THIS LIMITED WARRANTY APPLIES IS A “CONSUMER PRODUCT” UNDER THE MAGNUSON-MOSS WARRANTY ACT (15 U.S.C.A, 2301, ET SEQ) OR OTHER APPLICABLE LAW.  THE FOREGOING DISCLAIMER OF IMPLIED WARRANTIES SHALL NOT APPLY TO YOU AND ALL IMPLIED WARRANTIES ON THIS PRODUCT INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR THE PARTICULAR PURPOSE SHALL APPLY AS PROVIDED UNDER APPLICABLE LAW.

OTHER CONDITIONS

This limited warranty gives you specific legal rights, and you may have other right which vary from country to country or state to state.
